The CFPB’s Section 1071 Rule is Back in the Spotlight – Are You Ready?

- After the U.S. Supreme Court upheld the CFPB’s funding structure in May 2024, the CFPB extended the compliance dates for the CFPB’s Section 1071 rule addressing small business lending data collection requirements. This puts the Section 1071 rule back in the spotlight, and institutions subject to the rule will need to work towards complying with the rule. In this session, we will discuss which institutions are subject to the Section 1071 rule, the new extended compliance dates, and we'll provide an overview of the rule. We will also discuss potential pitfalls and concerns for lenders, such as fair lending issues, reputational concerns, changes to the application process for small business loans, and training staff. We will also cover some examples and case studies.

Bracing for the impact of the Silver Tsunami: When Fraud Losses become Bank Liabilities

- Senate Bill 278 shifts liability for fraud losses of older clientele to banks, unless specific efforts are made by front line personnel to stop the fraudulent transaction at the point of initiation. At the same time, banks are being hit with wave after wave of check fraud, must return counterfeit items within 24 hours of clearing the bank to avoid losses. Incidences of cybercrime continue to mount while questions arise regarding bank liability for Zelle payment fraud and fraudulently induced wires under Regulation. Combine each of these threats and you will quickly realize why operational risk may be the biggest threat to your strategic plan goals in 2025 and beyond. This session will cover recent fraud trends, including the use of AI and technology making these attempts even harder to detect. Attendees will also gain insights into tools for working with clients to prevent fraudulent transactions, learn about developing relationships with law enforcement to facilitate faster action, and hear about new technology solutions to detect fraud and elder financial abuse.

- In recent years, the CFPB has been focusing on a number of fees, essentially alleging them to be in violation of the CFPB’s UDAAP authority. It’s not only the CFPB, either: the White House has made so-called “junk fees” on of their primary areas of focus, and not just in the financial services environment. So, what to do about this? What might be considered a “junk fee”? What are the primary areas of focus from a regulatory perspective, and what should we be looking out for both now and in the future?
