Kevin Gould is the president and CEO of the California Bankers Association (CBA). In his role, he is responsible for executing the association’s mission and vision. Jason Lane is vice president and acting director of government relations for the California Bankers Association and manages California state tax policy for the association, which involves analyzing legislation and regulatory activity, and the development of policy positions for the association. Lane is one of three lobbyists at CBA and, in addition to his primary focus on taxation, he also lobbies on behalf of the association on issues related to the state budget, and consumer lending legislation. Brian is best known for his service as acting U.S. Comptroller of the Currency, FDIC board member, and voting member of the Financial Stability Oversight Council during the first year of the Covid-19 pandemic. In that capacity, he led government policy efforts on bank-fintech partnerships, brokered deposit arrangements, bank liquidity rules, fiduciary powers, national bank preemption, and other important issues. He also signed the Fair Access Rule, designed to ensure open access to the banking system for all legal businesses.

New Interagency Guidance on Third-Party Risk Management, Compliance and Recent Consent Orders

Third party relationships, whether for core data processing, loan referrals, website hosting or any of the other vast array of services, are expected to be managed in a manner that ensures continued regulatory compliance and sound risk management. In recent years it has also become more common for financial institutions to partner with fintech companies to offer products or services under unique and innovative structures. On June 6, 2023 the FRB, FDIC and OCC issued final joint guidance intended to assist banking organizations manage third party relationship risks. The Interagency Guidance on Third-Party Risk Relationships: Risk Management rescinds and replaces certain prior guidance on the topic. We will provide an overview of the Guidance, identify what has been rescinded and include key take-aways and practice pointers. Our presenters will also share insight into current challenges involving “vendor” third-party risk management.

A Focus on Flood Insurance Issues for Commercial Lenders

Many lenders continue to struggle with flood insurance regulation compliance, and especially in connection with commercial loans. It also remains a hot button issue in examinations.
