He was formerly a senior vice president & senior company counsel with Wells Fargo Bank, N.A., from 1997-2020, specializing in bank operations with an emphasis on Articles 3, 4 and 4A of the UCC; unclaimed property; Regulations D, E, CC, DD, GG, and the NACHA Operating Rules. He is an advisor to the CBA Legal Affairs Committee.

Ben is a strategic financial services lawyer and business leader with over 15 years’ experience as an in-house and outside counsel to banks and fintechs, most recently as a Vice President and Associate General Counsel at First Republic Bank (now a brand of J.P. Morgan Chase), where Ben served as the lead counsel to the bank’s mortgage lending business. Ben has worked across a variety of industry verticals, through which experiences he has engaged with and counseled his clients on a variety of issues at the intersection of financial services and artificial intelligence. Ben is currently in his second term as co-president of the Bay Area Financial Services Legal Association (BAFSLA), chair of the American Bar Association’s (ABA) Consumer Financial Services – Housing Finance subcommittee, and vice chair of the California Lawyer’s Association’s (CLA) Financial Institutions Committee.

Bank counsel face the task of counseling their internal clients to address the operational concerns arising from the new CFPB Section 1071 Small Business Lending Data Collection final rule and the proposed Community Reinvestment Act rule, which will soon be issued as a final rule. As a part of this, counsel must be aware of interplays between these two rules and how they impact one another. Join us for a lively discussion of operational issues that must be addressed under these two rules, such as data maintenance and review, performing and responding to fair lending data analysis, adjusting and identifying assessment areas, and understanding new CRA examination and testing scenarios. Generative AI in Banking and Financial Services – Opportunities, Challenges, and Approach
Generative artificial intelligence (AI) will change the way that we live and work. While the banking and financial services (BFS) industry has historically been a laggard in the technology adoption life cycle, generative AI seems poised to push BFS towards early adoption – which, in turn, will necessitate BFS professionals to become familiar with generative AI vis-à-vis their individual functions. In this panel, David Gormley and Ben Spohn will demythologize generative AI (what the heck is this “generative AI” thing, anyway?), describe and analyze several real-time industry trends, and prognosticate as to the future of generative AI in the BFS industry. In so doing, the panelists will discuss various opportunities and challenges such use cases present, including legal, regulatory, and enterprise risk considerations.
