Ninth Circuit Court of Appeals upholds banks' right to maintain
competition
California Bankers Association responds
SACRAMENTO - October 25, 2002 - The following statement is from
the California Bankers Association (CBA) regarding the Ninth Circuit
Court of Appeals' confirmation of federal regulators' jurisdiction
over ATM fees:
"The California Bankers Association is pleased with the Ninth
Circuit Court of Appeals' decision recognizing the Office of the
Comptroller of Currency and the Office of Thrift Supervision's exclusive
jurisdiction over banks' ability to charge fees for services. The
CBA has long believed, and this decision confirms, that municipalities
have no authority in limiting or otherwise determining a bank's
authority to charge fees for services provided to customers."
